Privacy Policy

This «Privacy Policy» (hereinafter referred to as the «Policy») governs the relationships regarding the protection of personal data of visitors to the website https://nationcode47.in.ua/ (hereinafter referred to as the «Website»), which belongs to the CHARITABLE ORGANIZATION «CHARITABLE FOUNDATION «CODE OF NATION 47» (identification code of the legal entity 45480057, located at: Ukraine, Lviv, Rudnenska St., 12), registered in accordance with the current legislation of Ukraine (hereinafter referred to as the «Foundation»).

1. General Provisions

1.1. In this Policy, the terms are used in the following meanings:

  • Personal data base: a named collection of organized personal data in electronic form and/or in the form of personal data files.
  • Consent of the personal data subject: voluntary expression of the will of a natural person (provided they are informed) to give permission for the processing of their personal data in accordance with the purpose formulated for such processing, expressed in a form that allows the conclusion of consent.
  • Personal data processing: any action or set of actions, such as collection, registration, accumulation, storage, adaptation, modification, updating, use, and dissemination (distribution, realization, transfer), anonymization, destruction of personal data, including using information (automated) systems.
  • Personal data: information or a set of information about an identified or identifiable natural person.
  • Personal data subject: a natural person whose personal data is being processed.
  • Third party: any person, other than the personal data subject, the controller, or the processor of personal data.

All other terms in the Policy are used in the meanings defined by the current legislation of Ukraine, including ratified international legal acts in Ukraine.

1.2. This Policy is developed to inform the personal data subjects about the procedure for processing their personal data while visiting/using the Website, and to ensure the protection of their personal data during such processing.

1.3. This Policy, as well as the Fund’s activities related to the collection, processing, storage, and other legal actions concerning personal data, is regulated by:

  • The Constitution of Ukraine;
  • The Law of Ukraine   «On Personal Data Protection» dated June 1, 2010, No. 2287-VI;
  • Other current legal acts of Ukraine that regulate the protection of personal data;
  • Ratified international legal acts in Ukraine. Legal relationships arising for the Fund in connection with the processing of personal data of residents of foreign jurisdictions are also governed by law (including international law), national and international legal acts that regulate the protection of personal data of residents of such countries.

1.4. The owner of the personal data processed in connection with the visit/use of the Website options is the Fund. The Fund has the right to delegate the full or partial processing of personal data to third parties based on an agreement concluded in accordance with the requirements of the current legislation.

1.5. A natural person is a subject of personal data under this Policy if they are a visitor to the Website, including if they use any options available on the Website, including providing the Fund with information about their email address and name.

1.6. The Fund guarantees that:

  • It complies with appropriate practices and regulatory requirements for the protection of personal data;
  • It protects the rights of personal data subjects;
    It prevents the risk of personal data processing security breaches.

1.7. The purpose of processing personal data obtained during the operation of the Website is to perform the statutory activities of the Fund.

1.8. The placement of this Policy via the link specified in clause 4.1 of this Policy serves as a notice to the personal data subjects about the Data Controller, the types and contents of personal data collected in connection with the visit/use of the Website, the rights of such subjects, the purpose of collecting their personal data, and third parties to whom such personal data may be transferred.

2. Processing of Personal Data

2.1. The Fund may collect and process the following information about you:

  • Information you provide to the Fund: This includes information about you that you provide by using the Website and its options, subscribing to email updates, making charitable donations (contributions) via the Website options, communicating with the Fund through the available Website options, etc.;
  • Information about you collected by the Website and other systems:
    1. If you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, the pages on the Website that you visit, and your Internet Protocol (IP) address;
    2. The Website may also load cookies onto your device;
    3. If you contact Fund staff via the Website or other electronic means of communication.
  • Information collected by third parties about you on the Website through actions: This refers to the information about you that you provide to third parties (e.g., Facebook, Google, Twitter) by using social media sharing options available on the Website, navigating from one page to another, or viewing materials containing links (leading to) other platforms (websites).

2.2. How the Fund processes your personal data depends on how you use the Website and interact with it. Some information may be provided directly by you while using the Website or in other ways; other information may be collected and processed by the Fund using automated technologies employed on the Website.

2.3. Legal grounds for data processing: When visiting the Website, the Fund processes your personal data if:

  1. The Fund has obtained your consent for such processing;
  2. Your personal data is necessary for the Fund to enter into and perform a contract with you or to take steps prior to entering into a contract;
  3. In cases where the Fund has a legitimate interest in processing your personal data, and this legitimate interest does not outweigh your interests regarding data protection or your fundamental rights and freedoms;
  4. In other cases, as defined by applicable law. In some cases, the Fund may have a legal obligation to process your personal data or will process your personal data for the purpose of forming, exercising, or defending legal claims.

2.4. Automated processing mechanisms: The Fund and third parties may use automated processing technologies to process information in certain sections of the Website. The Fund uses cookies to store content and settings, enabling the Fund to process standard information sent by your browser to certain websites you visit, such as your IP address, browser type and language, the website you came from, the pages you visit, and the links you click on the Website. The presence of such technical information helps the Fund improve the Website.

2.5. The Fund may use your personal data only for the purpose and in accordance with the objectives defined by this Policy and applicable law, including (but not limited to):

  1. To process your request (inquiry) to the Fund made via the Website;
  2. To facilitate your charitable donations (contributions) via options available on the Website;
  3. To implement other statutory goals of the Fund in accordance with applicable law;
  4. To send emails to your address regarding advertising (promotional) materials, information about the commencement of charitable projects, requests, and invitations for feedback on charitable activities, visiting the web resource, etc.

2.6. The Fund may accumulate personal data processed during your visit/use of the Website, including by entering this data into a personal data base. Storage of your personal data is done in accordance with the requirements of applicable legislation in the field of personal data protection.

2.7. The dissemination of your personal data is carried out only with your consent or in cases defined by this Policy and applicable law.

2.8. The Fund may partially publish user data on its Website in the «Reports» and «Receipts» sections.

2.9. Your personal data is subject to deletion or destruction in case of:
• Expiry of the 2-year retention period or another period defined by applicable law;
• Termination of the legal relationship between the personal data subject and the Fund, unless otherwise provided by law;
• Other cases defined by applicable data protection legislation.

2.10. The Fund does not process personal data concerning racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties and trade unions, criminal convictions, as well as data concerning health, sexual life, biometric or genetic data, except in cases defined by law.

3. Rights of Personal Data Subjects

3.1. When visiting/using the Website, you have the right to:

  • Receive information from the Fund, not defined in this Policy, regarding the processing and conditions for access to your personal data, or give appropriate instructions for receiving such information from persons authorized by you, except in cases defined by law;
  • Have free access to your personal data;
    Receive a response to an inquiry regarding the processing of your personal data within the procedure and time frame specified by applicable law;
    Submit a substantiated objection to the processing of your personal data or request the modification or destruction of your personal data if such data is processed unlawfully or is inaccurate;
  • Protect your personal data from unlawful processing and accidental loss, destruction, or damage due to intentional concealment, failure to provide, or untimely provision, as well as protection against the provision of information that is inaccurate or tarnishes your honor, dignity, or business reputation;
  • Withdraw your consent to the processing of personal data; and exercise other rights as defined by applicable data protection legislation.

4. Changes to the Privacy Policy
